Terms and Conditions

These terms and conditions (“Agreement”) constitute a legal agreement between you (“User” or “you”) and CCFWE (“Company,” “we,” “us,” or “our”) that governs your access and use of the STEAR mobile application (the “App”).

Acceptance of Terms and Conditions

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms and conditions, you should not use the App.

Use of the App

You may use the App solely for lawful purposes and in accordance with this Agreement. You agree not to use the App:

1. In any way that violates any applicable federal, state, local, or international law or regulation.
2. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
3. To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
4. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by the Company, may harm the Company or users of the App.

Intellectual Property Right

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” with all faults and without warranty of any kind. The Company makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the App or the information, products, services, or related graphics contained in the App for any purpose.

Limitation of Liability

In no event shall the Company or its directors, officers, employees, agents, partners, or suppliers be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising out of or in connection with your use of the App, including but not limited to loss of data, revenue, or profits.

Termination

The Company reserves the right to terminate your access to the App at any time for any reason or no reason without notice.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws Canada, without regard to its conflict of laws provisions. Any legal action arising out of or relating to this Agreement shall be filed only in the state or federal courts located in Canada and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Changes to Terms and Conditions

The Company may revise and update this Agreement from time to time at its sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the App thereafter.
